Terms of Service

These Terms of Service, together with our Privacy Policy, govern your use of the DogJourney application.

1. Agreement to the terms

The application is owned and operated by Opt-in Solutions Burns, a sole proprietorship (“DogJourney”, “we”, “us”, or “our”) of 19 Bäretstrasse, 3930 Visp, Canton Valais, Switzerland, company UID CHE-326.304.911.

The term “you” refers to the subscriber and/or registered user (together a “registered user”), or a user or viewer of our application.

These Terms of Service (“Terms”) govern your use of DogJourney (the “Service” or “Application”). Together with our Privacy Policy, they govern our relationship with you regarding use of the application.

Creating an account requires an active acknowledgement that you have read and agree to these Terms and that you have been shown our Privacy Policy. Cookie choices are separate and are not a substitute for this acknowledgement.

You can browse some public pages without an account. We do not treat merely visiting those pages as acceptance of these Terms. Using account, planning, billing, or other signed-in features requires you to accept these Terms.

2. Access

You will be able to access parts of the application without having to register any details with us. From time to time, certain areas may be accessible only if you are a registered user.

You are responsible for making all arrangements necessary for you to have access to our Application. You are also responsible for ensuring that all persons who access our Application through your internet connection are aware of these Terms, and that they comply with them.

We make reasonable efforts to ensure that this Application is available to view and use 24 hours a day throughout each year; however, this is not guaranteed. The Application may be temporarily unavailable at any time because of server or systems failure or other technical issues, reasons that are beyond our control, or required updating, maintenance, or repair.

Where possible we will try to give you advance warning of maintenance issues but shall not be obliged to do so.

3. Registering on this application

When registering on the Application you must choose a username and password, or use a supported sign-in provider. You are responsible for all actions taken under your chosen username and password or signed-in account.

If you use Google or Apple Sign-In, you are also subject to those providers’ terms for authentication.

  • All the details you provide to us for the purpose of registering are true, accurate, current, and complete in all respects
  • You will notify us immediately of any changes to the information provided on registration
  • You will only use the Application using your own username and password
  • You will make every effort to keep your password safe and will not disclose it to anyone
  • You will change your password immediately upon discovering that it has been compromised
  • You will neither transfer nor sell your username or password to anyone, nor permit anyone other than you to use them, either directly or indirectly

Identity checks

We may use the name, address, and other personal information you supply (including updated information) to authenticate your identity where reasonably necessary to operate the Service, prevent fraud, or meet legal obligations. DogJourney does not obtain consumer credit reports as part of ordinary account registration or trip-planning purchases.

4. Eligibility to purchase

To be eligible to purchase paid products on this Application and lawfully enter into contracts with us, you must:

  • Be legally capable of entering into a binding contract under the law that applies to you
  • Provide accurate account and billing details. Paid DogJourney products are digital trip-planning services, not physical goods delivered by post

5. The DogJourney service

DogJourney may provide dog-friendly trip planning features, including:

  • AI-assisted itinerary generation through DJ
  • Recommendations for accommodation, restaurants, activities, and related services
  • Dog profiles and saved trips
  • Explore listings and partner listings
  • Trip packages, modification allowances/tokens, and billing features
  • Links to an external shop for dog-travel products where offered
  • Support and account features

Scope

Features may vary by plan, region, and product stage. We do not promise that every listed capability is available to every user at all times.

6. Planning information and limitations

Recommendations and itineraries are informational planning aids.

Business policies, prices, availability, opening hours, and dog rules may change or be incomplete. Dog-friendly information can change. Always confirm current access rules, fees, size restrictions, and booking requirements directly with the provider.

DogJourney does not guarantee admission, booking success, availability, safety, suitability for your dog, or uninterrupted service.

Travel times and durations are estimates. DJ does not replace official travel, border, transport, veterinary, medical, legal, or immigration advice.

It is your responsibility to ensure that any services or information available through the Application meet your specific requirements.

7. Dog travel responsibilities

You remain responsible for:

  • Checking current dog-entry, transport, vaccination, and documentation requirements
  • Checking business policies and confirming bookings directly
  • Ensuring your dog is safe and suitable for planned activities
  • Complying with local laws and venue rules
  • Making final travel and booking decisions

8. AI assistant terms

DJ generates suggestions based on available information and your inputs. AI outputs may contain errors or omissions.

DJ uses AI to help organise your trip. Suggestions may be incomplete or change over time, so please check provider details, availability, prices, travel rules, and dog policies before booking or travelling.

Review important information yourself. Do not treat DJ as a professional medical, veterinary, legal, immigration, or official travel adviser.

You remain responsible for final decisions, bookings, and compliance with applicable rules.

9. Trip plans and modifications

You may create and update trip plans within the Service. Minor same-day adjustments (such as reordering activities or editing times within a day) are generally treated as ordinary planning edits.

Significant changes to trip scope may consume modification allowances/tokens according to the plan you purchased, or may require starting a new trip when the change is outside the original scope.

Where itinerary version history is available, you may restore a previous version according to the product’s restore controls.

Exact token balances and plan inclusions are shown in your account/planner experience and may change with the product catalogue.

10. Subscriptions and fees

DogJourney may charge on the website for Annual and Monthly subscriptions, Single Trip packages, and DJ modification add-ons. Website payments are processed by Stripe. DogJourney does not store your full card number.

Annual and Monthly plans renew automatically unless you cancel before the renewal date shown at checkout or in the Stripe Customer Portal. A Single Trip purchase is a one-time payment for planning that specific trip and does not create a recurring subscription.

The current iOS app does not sell these digital products and does not implement Apple In-App Purchase. Do not use iOS to check out through Stripe until a separate Apple-compliant purchase path is approved.

Any prices and offers are only valid at the time they are published on the Application. All prices and descriptions provided supersede all previous publications.

Failed payments may result in delayed access to paid features. Price changes will be communicated in accordance with applicable law. Drawings, images, descriptive matter, and specifications on the Application are for general information only and should be used as a guide.

Refunds, cancellation, and withdrawal

Nothing in these Terms affects statutory consumer rights that cannot be waived.

Annual and Monthly subscriptions can be cancelled in the Stripe Customer Portal before the renewal date shown there. Cancellation stops future renewals. Unless the law requires otherwise, or we agree otherwise in writing, we do not refund the unused part of an already-paid subscription period.

A Single Trip purchase and DJ modification add-ons are one-time digital planning services. If you are a consumer in the EEA or the United Kingdom, you may have a 14-day right of withdrawal for distance contracts. If you ask us to start generating a trip plan, preview, or itinerary during that period, you acknowledge that performance of the digital service has begun and that you lose the withdrawal right once that generation starts, where the applicable law allows this.

If we fail to provide the paid planning service, or it is defective, contact us and we will repair, replace, or refund as required by law.

The current iOS app does not sell these digital products and does not implement Apple In-App Purchase, so there is no Apple App Store refund path in this app.

Purchases from any linked shop are handled under that storefront’s own refund and returns policy.

11. Shop and third-party products

Where DogJourney links to an external shop (for example via Shopify), product purchase, shipping, returns, and warranties are handled under that storefront’s own terms and policies unless we clearly state otherwise.

This section applies when the shop is active. Product availability is not guaranteed.

12. Partner businesses

Trusted-partner and verification statuses indicate that a business meets defined DogJourney criteria at the time of review. They do not guarantee every aspect of the business or suitability for every dog.

Commercial relationships do not automatically make a recommendation right for you. Confirm details directly before booking.

13. User content

You retain ownership of content you submit (such as trip notes, dog photos, documents you upload, feedback, and partner application materials).

You grant DogJourney a limited licence to host, process, display, and use that content as needed to operate and improve the Service.

When content is deleted from your account or your account is deleted, we will stop active use of that content except where retention is required for legal, security, or accounting reasons.

14. Intellectual property

The content of the Application is protected by copyright (including design copyrights), trade marks, patent, database and other intellectual property rights and similar proprietary rights which include, without limitation, all rights in materials, works, techniques, computer programs, source codes, data, technical information, trading business brand names, goodwill, the style or presentation of the goods or services, creations, inventions or improvements upon or additions to an invention, confidential information, know-how, and any research effort relating to Opt-in Solutions Burns trading as DogJourney, moral rights, and any similar rights in any country (whether registered or unregistered and including applications for and the right to apply for them).

You acknowledge that the intellectual property rights in the material and content supplied as part of the Application shall remain with us or our licensors.

You may download or copy the content and other downloadable items displayed on the Application subject to the condition that the material may only be used for personal non-commercial purposes. Copying or storing the contents of the Application for other than personal use is expressly prohibited.

You may retrieve and display the content of the Application on a computer screen, store such content in electronic form on disk (but not any server or other storage device connected to a network), or print one copy of such content for your own personal, non-commercial use, provided you keep intact all and any copyright and proprietary notices.

You may not otherwise reproduce, modify, copy, distribute, or use for commercial purposes any of the materials or content on the Application.

You acknowledge that any other use of the material and content of this Application is strictly prohibited and you agree not to (and agree not to assist or facilitate any third party to) copy, reproduce, transmit, publish, display, distribute, commercially exploit, or create derivative works from such material and content.

No licence is granted to you to use any of our trade marks or those of any affiliated businesses. These Terms do not transfer ownership of our intellectual property to you.

15. Disclaimer

The Application is provided on an “as is” and “as available” basis without any representation or endorsement made, and we make no warranties or guarantees, whether express or implied, statutory or otherwise (unless otherwise expressly stated in these Terms or required by law) in relation to the information, materials, content, or services found or offered on the Application for any particular purpose or any transaction that may be conducted on or through the Application, including but not limited to implied warranties of non-infringement, compatibility, timeliness, performance, security, accuracy, condition or completeness, or any implied warranty arising from course of dealing or usage or trade custom.

We attempt to ensure that the information available on the Application at any time is accurate. However, we do not guarantee the accuracy or completeness of material on this Application. We use all reasonable endeavours to correct errors and omissions as quickly as practicable after becoming aware or being notified of them. We make no commitment to ensure that such material is correct or up to date.

We make no representation or warranty of any kind regarding the availability of the Application or that it will be timely or error-free, that defects will be corrected, or that the Application or the server that makes it available are free of viruses or bugs.

We will not be responsible or liable to you for any loss of content or material uploaded or transmitted through the Application, and we accept no liability of any kind for any loss or damage from action taken in reliance on material or information contained on the Application. This includes AI output, travel information, dog policies, prices, availability, safety, official documentation, border or transport rules, health or veterinary matters, and third-party providers.

We take reasonable care to protect the Application and your information, as described in our Privacy Policy. No online service is completely secure. You remain responsible for protecting your password and device.

Except where we cannot exclude liability by law, we are not liable for damage or loss caused by a distributed denial-of-service attack, or by viruses, trojans, worms, logic bombs, keystroke loggers, spyware, adware, or other malicious or technologically harmful material that may infect your computer, equipment, programs, data, or other proprietary material as a result of your use of the Application or downloading any material posted or sold on the Application or from any application linked to it.

We reserve the right to disclose such information to law enforcement authorities as we reasonably feel is necessary should you breach this agreement.

Nothing in these Terms is intended to exclude liability that cannot be excluded under applicable law.

16. Use of the application

You are permitted to use the Application and the material contained in it only as expressly authorised by us and in accordance with these Terms, as may be amended from time to time. Material changes to these Terms will be indicated by the dates and version shown at the top of this page, and we may require you to accept the updated Terms before continuing to use account features.

We provide access and use of the Application on the basis that we exclude all representations, warranties, and conditions to the maximum extent permitted by law.

We reserve the right to make changes to the information or materials on this Application at any time; to temporarily or permanently change, suspend, or discontinue any aspect of the Application, including the availability of any features, information, database, or content, or restrict access to parts of or the entire Application; and to refuse to post material on the Application or to remove material already posted.

You may not use the Application for any of the following purposes:

  • Disseminating any unlawful, harassing, libellous, abusive, threatening, harmful, vulgar, obscene, or otherwise objectionable material
  • Transmitting material that encourages conduct that constitutes a criminal offence or results in civil liability
  • Breaching any applicable local, national, or international laws, regulations, or code of practice
  • Gaining unauthorised access to other computer systems, or attempting to access another user’s account
  • Interfering with any other person’s use or enjoyment of the Application
  • Breaching any laws concerning the use of public telecommunications networks
  • Interfering with, disrupting, or damaging networks or applications connected to the Application
  • Using data mining, robots, or similar data-gathering and extraction tools to extract (whether once or many times) any substantial parts of the Application for re-utilisation
  • Transmitting, or procuring the sending of, any unsolicited or unauthorised advertising or promotional material or any other form of similar solicitation
  • Creating and/or publishing your own database that features all or substantial parts of the Application
  • Making, transmitting, or storing electronic copies of materials protected by copyright without the prior permission of the owner
  • Abusing DJ or overloading systems, or scraping, copying, or reverse engineering proprietary planning logic beyond ordinary use
  • Knowingly introducing viruses, trojans, worms, logic bombs, keystroke loggers, spyware, adware, or other malicious or technologically harmful material
  • Attempting to gain unauthorised access to the Application, the server on which it is stored, or any server, computer, or database connected to it
  • Attacking the Application via a denial-of-service attack or a distributed denial-of-service attack

Criminal offences

A breach of this clause may be a criminal offence under the Swiss Criminal Code, the Budapest Convention on Cybercrime (which applies across the EEA), the Computer Misuse Act 1990 (UK), or other specific legislation in any other country. We may report any such breach to the relevant law enforcement authorities and disclose your identity to them. In the event of such a breach, your right to use the Application will cease immediately.

17. Suspending or terminating your access

You may stop using the Service at any time. You may delete your account in Settings / Account → Delete your DogJourney account, as described in the Privacy Policy.

Account deletion does not automatically cancel a Stripe subscription. Cancel billing in the website billing portal if you have a Stripe subscription.

We reserve the right to terminate or suspend your access to the Application immediately and without notice to you if:

  • You fail to make any payment to us when due
  • You breach these Terms (repeatedly or otherwise)
  • You are impersonating any other person or entity
  • When requested by us to do so, you fail to provide us within a reasonable time with sufficient information to enable us to determine the accuracy and validity of any information supplied by you, or your identity
  • We suspect you have engaged, or are about to engage, or have in any way been involved, in fraudulent or illegal activity on the Application
  • We must do so to protect the Service or other users, or for legal or security reasons

Survival

Outstanding payment obligations and legally required record retention survive termination where applicable.

18. Linking to the application

You may link to the Application’s homepage in a way that is fair, legal, and does not damage our reputation or suggest any form of association, approval, or endorsement where none exists. You must not link from a site that is unlawful or that infringes anyone’s rights.

We have no obligation to inform you if the address of the Application home page changes. We may ask you to remove a link, and you must do so if we do.

19. External links

To provide increased value and convenience to our users, we may provide links to other applications or resources for you to access at your sole discretion and risk. You acknowledge and agree that, as you have chosen to enter the linked application, we are not responsible for the availability of such external sites or resources, and do not review or endorse and are not responsible or liable in any way, whether directly or indirectly, for:

  • The privacy practices of such applications
  • The content of such applications, including (without limitation) any advertising, content, products, goods, or other materials or services on or available from such applications or resources
  • The use which others make of these applications
  • Any damage, loss, or offence caused or alleged to be caused to you, arising from or in connection with the use of or reliance upon any such advertising, content, products, goods, materials, or services available on and/or purchased by you from such external applications or resources

Third-party services

The Service may link to or rely on third parties such as payment providers, maps, transport providers, accommodation providers, restaurants, activities, and booking sites. Those third parties are responsible for their own services, policies, availability, and content. DogJourney is not responsible for independent third-party services.

20. Availability and changes

We reserve the right to change the domain address of this Application and any services, products, product prices, product specifications, and availability at any time.

We may update, suspend, or remove features; change recommendation sources; update partner listings; or modify pricing.

We do not promise uninterrupted or error-free access. We will not be liable to you if the Application is unavailable at any time, except where liability cannot be excluded by law.

21. Limitation of liability

Notwithstanding any other provision in these Terms, nothing will affect or limit your statutory rights, or will exclude or limit our liability for:

  • Death or personal injury resulting from our negligence
  • Fraud or fraudulent misrepresentation
  • Action pursuant to Article 2, paragraph 1, letter b of the Swiss Product Liability Act, or the equivalent in other EEA states
  • Any matter for which it would be unlawful for us to exclude or attempt to exclude our liability

Excluded losses

We will not be liable, in contract or extra-contractual liability (including, without limitation, negligence), or in respect of pre-contract or other representations (other than wilful deception or culpa in contrahendo) or otherwise for the following losses which you have suffered or incurred arising out of or in connection with these Terms, even if such losses are foreseeable or result from a deliberate breach by us or as a result of any action we have taken in response to your breach:

  • Any economic losses (including without limitation loss of revenues, profits, contracts, business, or anticipated savings)
  • Any loss of goodwill or reputation
  • Any special or indirect losses
  • Any loss of data
  • Wasted management or office time
  • Any other loss or damage of any kind, to the fullest extent permitted by law

22. Indemnity

You agree to indemnify, defend, and hold harmless Opt-in Solutions Burns, a sole proprietorship trading as DogJourney, from and against claims, including losses (including loss of profit, revenue, goodwill, or reputation), costs, and reasonable administrative and legal expenses, arising out of your breach of these Terms, or out of your use of this Application or any other person accessing the Application using your personal information with your authority.

This clause does not affect your statutory rights as a consumer.

23. General

If any provision of these Terms is held by any competent authority to be invalid or unenforceable in whole or in part, the validity of the other provisions and the remainder of the provision in question will not be affected.

All contracts are concluded and available in English only. The Privacy Policy and these Terms are currently provided in English. Professional translations may be published later.

If we fail at any time to insist upon strict performance of any of your obligations under these Terms, or if we fail to exercise any of the rights or remedies to which we are entitled, it shall not constitute a waiver of such rights or remedies and shall not relieve you from compliance with your obligations.

A waiver by us of any default shall not constitute a waiver of any subsequent default. No waiver by us of any of these Terms shall be effective unless it is expressly stated to be a waiver and is communicated to you in writing.

24. Governing law and jurisdiction

The Application is controlled and operated in Switzerland.

These Terms will be governed by the laws of Switzerland and you irrevocably agree to submit to the exclusive jurisdiction of the courts of Switzerland.

25. Changes to these terms

We may update these Terms from time to time. The effective and last-updated dates appear at the top of this page.

If we update these Terms in a way that requires a new acknowledgement, we will ask you to review and accept the updated Terms before you continue using account features. We do not treat merely visiting public pages as acceptance of updated Terms.

26. Cookies and similar technologies

Use of the website involves cookies and similar technologies as described in these paragraphs, in our Privacy Policy, and in full on the Cookie details page at /cookies.

Cookies are small text files stored on your device. Similar technologies include local storage, session storage, and scripts that can store or read identifiers. The Cookie details page at /cookies is the full, current inventory of what DogJourney uses. It is not legal advice.

Necessary cookies keep the website secure and working. They include Supabase sign-in cookies, a language cookie named dj_locale (up to 365 days), a first-party dj_consent cookie that stores your cookie-preference choice, short-lived dj_legal_pending tokens during sign-up, planner-draft storage, and session storage used to resume checkout, planning jobs, or onboarding.

Preferences storage can remember optional choices, such as whether you prefer Apple Maps or Google Maps for directions links. This is off until you choose it.

Analytics cookies would help us understand how the website is used. They are not currently used. Marketing cookies would help measure or personalise marketing. They are not currently used.

DogJourney currently uses essential cookies and first-party storage needed to run the service, plus optional maps-app memory if you allow preferences cookies.

We do not currently use: Google Analytics, PostHog, Mixpanel, Vercel Analytics, Vercel Speed Insights, Sentry, Datadog, Bugsnag, advertising pixels, tag managers, session replay, heatmaps, embedded Instagram or social widgets, chat widgets.

We do not load analytics, advertising, or marketing scripts before consent — and we do not load them at all today, because they are not part of the product.

Map tiles, geocoding, payments, and AI planning are loaded or called only when you use those features. Stripe.js is not loaded on public pages. Checkout cookies may appear on Stripe’s domains after you start a payment or open the billing portal.

You can accept optional cookies, reject them, or manage preferences in the cookie banner. After you save a choice, use Cookie settings in the footer or in Account to change or withdraw it. Rejecting optional cookies is as easy as accepting them. Necessary cookies remain active because the website cannot work securely without them.

Closing the preferences window without saving does not count as consent. Scrolling or clicking elsewhere does not count as consent. Cookie choices are separate from the Terms of Service acknowledgement used when you create an account.

If we add a new optional technology, or change cookie purposes in a material way, we will update the consent version and ask again.

You can also block or delete cookies in your browser settings. Blocking essential cookies may sign you out or prevent the website from working correctly.

  • sb-*-auth-token (and chunked variants) — Supabase (First-party (DogJourney website host)). Keep you signed in, refresh the secure session, and protect account features. Stored as http cookie. Expiry: Managed by Supabase Auth (access token is short-lived; refresh token persists the session until sign-out or expiry).. First-party. Classification: essential. Does not wait for optional cookie consent. Required for sign-in, MFA, passkeys, and account security. Not used for advertising.
  • dj_locale — DogJourney (Opt-in Solutions Burns) (First-party). Remember the website language you use (English, German, French, or Italian). Stored as http cookie. Expiry: Up to 365 days. First-party. Classification: essential. Does not wait for optional cookie consent. Classified as strictly necessary because it only stores a service language preference so the site can work in the selected language. It is not used for analytics or advertising. Classification remains subject to legal review.
  • dj_consent — DogJourney (Opt-in Solutions Burns) (First-party). Store your cookie-preference choice and consent version. Stored as http cookie. Expiry: Up to 365 days (retention pending legal review). First-party. Classification: essential. Does not wait for optional cookie consent. Cookie-preference storage is treated as strictly necessary so we can remember and honour your choice.
  • dj_legal_pending — DogJourney (Opt-in Solutions Burns) (First-party). Hold a short-lived Terms acknowledgement token during account creation or OAuth sign-up. Stored as http cookie. Expiry: Up to 20 minutes for OAuth; up to 7 days for email sign-up confirmation. First-party. Classification: essential. Does not wait for optional cookie consent. Not a tracking cookie. Used only to complete contractual Terms acknowledgement.
  • dj.planner.briefDraft (and related keys) — DogJourney (First-party). Keep an in-progress trip brief so it is not lost while you plan. Stored as local storage. Expiry: Until you clear site data or the draft is converted/removed. First-party. Classification: essential. Does not wait for optional cookie consent.
  • dj_pending_trip_checkout, planning-job ids, MFA enrol state, onboarding flags — DogJourney (First-party). Resume checkout, planning jobs, security setup, and onboarding in the same browser session. Stored as session storage. Expiry: Mostly until the tab is closed; some onboarding flags persist locally until setup finishes. First-party. Classification: essential. Does not wait for optional cookie consent.
  • dogjourney.mapsProvider — DogJourney (First-party). Remember whether you prefer Apple Maps or Google Maps for directions hand-off links. Stored as local storage. Expiry: Until you clear site data or withdraw preferences consent. First-party. Classification: preferences. Optional — stored only after a saved preference. Stored only after preferences consent. Directions links still work without it.
  • Cormorant Garamond / Plus Jakarta Sans — DogJourney (self-hosted via Next.js next/font) (First-party). Display the website in the DogJourney typefaces. Stored as self hosted asset. Expiry: Cached by the browser as static assets. First-party. Classification: essential. Does not wait for optional cookie consent. Fonts are downloaded at build time and served from the DogJourney origin. They do not load Google Fonts in the browser.
  • Leaflet / OpenStreetMap tiles (unpkg + tile.openstreetmap.org) — unpkg / OpenStreetMap (unpkg.com, *.tile.openstreetmap.org). Show the Explore and itinerary maps after you open those screens. Stored as third party request. Expiry: Provider-controlled cache; OSM may set its own cookies on tile requests. Third-party. Classification: essential. Does not wait for optional cookie consent. Loaded only when you use a map view (not on public marketing pages). Treated as necessary for the map feature you requested. Legal review should confirm this classification.
